These terms and conditions (“Terms”) govern all advertisers (referred to as “Advertiser,” “you,” and “your”) who:
- Have placed an advertisement (the “Ad“) on https://recrutd.com/ or its subdomains or any other country-specific domains (the “Site”);
- Have been informed that applications submitted for the position advertised in the Ad will be stored on your behalf on Recrutd;
- Have utilized any features of the Site or Recrutd’s products offered through the Site.
Your access to and use of the information, materials, services, and products provided on this Site are conditional upon your acceptance and compliance with these Terms. These Terms apply alongside the Advertising Terms and Conditions.
The Site is owned byThe Great Learning Tree Pty Ltd, (ABN 145 031 563) and operated as Recrutd (referred to as “we,” “us,” and “our”). Your continued use of this Site constitutes acceptance of these Terms.
Variation of Terms
- Recrutd may vary these Terms at any time by publishing the revised Terms on the Site. This provides sufficient notice of the changes.
- You will be notified of any material changes that may be reasonably detrimental to you, 5 days before they take effect.
Intellectual Property Rights
- Recrutd retains all intellectual property rights in any goods, services, and products provided to you by Recrutd.
Limitation of Liability and Disclaimer
- Recrutd does not warrant that services available through the Site will be uninterrupted or error-free. Except where liability cannot be excluded by law, we, our officers, employees, agents, and contractors will not be liable for any loss or damage arising from your access and use of the Site.
- For goods or services supplied via the Site, liability for breach of an implied term that cannot be excluded is limited to either the supply of the goods or services again or the payment of the cost of having them supplied again.
- Our limitation of liability applies to all types of damages, including direct, indirect, consequential, special, punitive, and others, even if we are informed of their possibility.
- Recrutd accepts no responsibility for errors in your Ads. You must check your Ads for errors as soon as they are placed on the Site.
- Recrutd agrees to use reasonable efforts to publish Ads promptly.
- Recrutd does not guarantee that files available for download or sent via email through the Site will be free of viruses or other harmful code. You are responsible for implementing sufficient procedures and checkpoints to ensure accuracy of data input and output and maintaining a means to reconstruct lost data.
- Recrutd acts as a medium through which individuals seek employment opportunities and does not vet candidates or their representations, whether oral or written.
Changes to the Site
- Recrutd reserves the right to alter the functionality and appearance of its products and services available from the Site without notice. We will consider any exceptionally detrimental consequences such alterations may cause you.
Your Obligations
- You warrant and agree that:
- You have the legal capacity and power to agree to these Terms and perform the obligations under them;
- Ads and other works posted by you do not breach any third party’s intellectual property rights;
- All files delivered to Recrutd will be free of viruses;
- You will not use the Site for any illegal purpose;
- You will not use the Site to upload, download, store, or make available data that is unlawful or otherwise objectionable.
- You may not assign or transfer any rights and obligations under these Terms without Recrutd’s prior written approval.
- You indemnify Recrutd against all claims, actions, suits, liabilities, costs, damages, and expenses arising from any breach of these Terms, negligent act or omission, or actual breach of any law by you.
- You agree to handle any information or products provided by Recrutd in accordance with applicable laws.
- You may not modify, reproduce, republish, transmit, or distribute any material from the Site without permission.
- You may not use data mining tools or similar automated data gathering tools on the Site without Recrutd’s prior written approval.
- You may not post any pyramid schemes on the Site.
- You may not require candidates to pay any fee to apply for any job advertised on the Site.
- You may not use any feature of the Site to send unsolicited commercial messages to candidates.
- You must not release any publicity relating to Recrutd without Recrutd’s prior written approval.
- Ads acquired from Recrutd must not be on-sold or supplied to third parties unless approved by Recrutd.
- If you are a job recruiter, Ads must be branded with your recruiter brand or co-branded with your client’s brand.
- Breaching clauses 22 and 23 may result in the removal of your Ad from the Site.
Misuse of Candidate Data
- Any personally identifiable information of candidates obtained through the Site must only be used for genuine employment and recruitment activities.
- Selling services or products to candidates using their information obtained from the Site is prohibited.
- You may not forward candidate personal information to any other party without Recrutd’s consent.
- If Recrutd believes you have misused candidate data, it reserves the right to:
- Suspend or terminate your account;
- Remove your Ads;
- Report potential contraventions of privacy laws;
- Take legal action.
Placing Ads
- Posting a standard or ‘Basic’ Ad is free but limited to 100 live job Ads at one time.
- By posting an Ad, you accept that it may be distributed to third-party sites.
- Ads must comply with all applicable laws, regulations, and codes of conduct.
- You may not promote brands other than your business within job ads without Recrutd’s approval.
- Ads must be for genuine, paid employment opportunities that are current at the time of posting.
- Ads must be posted on the country-specific site where the job will be based.
- Ads must be posted to the appropriate category of the Site.
- Ads must only advertise one job role per Ad.
- Information entered into Ad data fields must directly relate to the relevant category.
- Standard or ‘Basic’ Ads are valid for 28 days.
- The following actions constitute a new/additional job Ad:
- Copying an Ad;
- Reposting an archived or deleted Ad;
- Changing a zone classification and refreshing a job posting;
- Posting Ads via bulk data import
- Changes to job advertisement details do not constitute a new Ad.
- Recrutd may post your Ad or versions of your Ad on the websites of its related bodies corporate.
Sponsored Ads
- Sponsored Ads appear at the top and bottom of job search results pages and are included in email alerts to candidates.
- Sponsored Ads will appear for the agreed-upon dates and may continue on a rolling month-to-month basis.
- While Sponsored Ads receive greater exposure, Recrutd does not guarantee an increase in applications.
- Sponsored Ads are for the Advertiser alone and may not be resold or transferred.
- Recrutd reserves the right to refuse or terminate the Sponsored Ad service.
- Recrutd reserves the right to change the cost of posting a Sponsored Ad.
- Advertisers can view candidate details for 60 days from the post expiry.
- Recrutd reserves the right to change the cost of posting a Sponsored Ad.
Self-Serve Paid Ads
- In select countries, Advertisers can pay for greater exposure of their Ads as ‘Paid’ Ads.
- ‘Paid’ Ads offer increased exposure compared to standard Ads.
- ‘Paid’ Ads offer even higher exposure than standard Ads.
- The cost of ‘Paid’ Ads is shown before purchase and may change at any time.
- Recrutd reserves the right to change the price of ‘Paid’ Ads.
- Increased exposure for ‘Paid’ Ads begins 1-2 hours after publication and payment.
- ‘Paid’ Ads receive various promotion measures at Recrutd’s discretion.
- Recrutd does not guarantee increased applications for ‘Paid’ Ads.
Payment
- For Sponsored Ads under a Service Agreement:
- Invoices are issued monthly for the prior month’s services.
- Payments must be made within 14 days of the invoice date.
- Payments can be made using VISA, Mastercard, or EFT.
- Interest may be charged on late payments.
- Non-payment may result in Ad removal and refusal of further services.
- Once confirmed, the Service Agreement cannot be changed or refunded.
- Full fees must be paid even if the Sponsored Ad functionality is not fully utilized or is withdrawn after confirmation.
- Recrutd may obtain credit information for collecting overdue payments.
- Recrutd may disclose this information to relevant parties.
- Payment for Self-Serve Paid Ads is managed by Stripe Payments Australia Pty Ltd (Stripe), and payment details must be provided to Stripe.
- By purchasing ‘Paid’ Ads, you accept Stripe’s General Terms of Service and Privacy Policy.
Ad Performance
- ‘Paid’ Ads receive measures to increase exposure and applications, but Recrutd does not guarantee increased applications.
- Recrutd does not guarantee increased applications for ‘Paid’ Ads.
Authority to Store and Retain Applications
- You expressly authorize Recrutd to store and retain all applications submitted in response to the Ad on our systems.
Access
- When a candidate applies to your Ad, their application will be available on the Recrutd platform and a notification email will be sent to you via the nominated email address provided by you upon your request to post a job Ad.
- It is your responsibility to notify us of a change of nominated email address.
Maintenance
- Recrutd will use reasonable endeavors to ensure that the Site is available for users at all times. Notwithstanding this, Recrutd and its third-party service providers may be required to undertake maintenance and upkeep of the Site from time to time. Recrutd will endeavor to limit any ‘downtime’ to periods outside of standard business hours. Recrutd provides no warranty that services available through the Site will be uninterrupted or error-free. Except where liability cannot be excluded by law, we, our officers, employees, agents, and contractors will not be liable for any loss or damage arising out of or in connection with your access and use of the Site.
Licence to Use Data
- Personally identifiable information in candidate applications is owned by the candidate and the Advertiser, and Recrutd must only deal with such information in accordance with applicable privacy laws.
- Candidate applications are owned by the Advertiser (excluding personal information) and stored on the Site on behalf of the Advertiser.
- The Advertiser grants Recrutd a perpetual, non-exclusive, irrevocable license to use any stored data (including candidate applications) to:
- Manage internal reporting requirements;
- Collate statistical information about use of the Site and submission of online applications;
- Analyze user behavior on the Site;
- Obtain and analyze high-level trends and prepare reports;
- Improve the candidate user experience
- The Advertiser grants Recrutd a perpetual, non-exclusive, irrevocable license to use and/or share Advertiser usage data (in accordance with applicable privacy laws) within its corporate group to improve the Advertiser experience.
- Advertiser usage data relates to an Advertiser’s engagement with the Site and the services offered.
Hardware & Software
- It is the Advertiser’s responsibility to ensure that it has the necessary computer hardware and software systems in place to access and utilize the Site and email communication.
General Terms
- Recrutd reserves the right to terminate your agreement if you post any Ad or utilize any feature of the Site or Recrutd Product in breach of these Terms without notice or compensation.
- Recrutd reserves the right to reject or remove any Ad from the Site for any reason.
- Termination of our agreement due to your breach of these Terms will not end provisions of these Terms that can survive termination.
- These terms are governed by the laws of New South Wales. Advertisers irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of New South Wales and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
